CUF Files Amicus Brief in Trump v. U.S. (On Application for Stay of the Mandate to be Issued by the United States Court of Appeals)

“Jack Smith does not have authority to conduct the prosecution underlying this case. Those actions can be taken only by persons properly appointed as federal officers to properly created federal offices. But neither Smith nor the position of Special Counsel under which he purportedly acts meets those criteria. And that is a serious problem for the rule of law.  The absence of such an appointment means that Smith lacks authority to prosecute Trump on behalf of the United States. That alone is sufficient to grant a stay.”
