CU and CUF File Amicus Brief in American Legion’s Bladensburg Cross Case
Citizens United and Citizens United Foundation have joined forces with other conservative groups in urging the Supreme Court to review and reverse a ruling by the 4th Circuit U.S. Court of Appeals, which held that the Bladensburg Memorial Cross, which has stood on public ground for over 100 years, is an unconstitutional entanglement between government and religion. Our amicus brief supports The American Legion’s call for clarification of the “confused state” of the Supreme Court’s Establishment Clause jurisprudence. More specifically, we urge the Court to abandon the framework derived from its 1971 decision in Lemon v. Kurtzman and apply, instead, “an interpretive test that is suited to the original text of the Establishment Clause.”
